OFFER AGREEMENT
Definitions
Site Visitor — a person who has visited the website https://bucocoffee.com.ua without the intention of placing an order.
User — an individual who visits the Website, accepts the terms of this Agreement, and intends to place an Order on https://bucocoffee.com.ua.
Buyer — a User who has placed an Order on https://bucocoffee.com.ua for the purpose of purchasing goods for personal needs.
Seller — Sole Proprietor (FOP) Sorochan T.V.
Online Store — the website located on the Internet at https://bucocoffee.com.ua, where the Goods offered by the Seller for purchase are presented, as well as the terms of payment and delivery of the Goods to Buyers.
Website — https://bucocoffee.com.ua.
Goods — food products and other goods offered for sale on the Seller’s Website.
Order — a duly completed request by the Buyer for the purchase and delivery of Goods selected on the Website to the address specified by the Buyer.
- General Provisions
1.1. The Seller sells Goods through the Online Store located at:
1.2. By ordering Goods through the Online Store, the User agrees to the terms and conditions of sale set forth below (hereinafter referred to as the "Terms of Sale"). If the User does not agree with these Terms, they must immediately cease using the service and leave the website https://bucocoffee.com.ua.
1.3. These Terms of Sale, as well as information about the Goods presented on the Website, constitute a public offer in accordance with Article 633 of the Civil Code of Ukraine.
1.4. These Terms may be amended by the Seller unilaterally without prior notice to the User/Buyer. The new version of the Terms shall enter into force upon publication on the Website unless otherwise specified.
1.5. This Agreement (hereinafter referred to as the "Agreement") comes into effect from the moment the Seller sends the Buyer an electronic confirmation of acceptance of the Order when placing an Order without authorization on the Website, as well as from the moment the Seller sends a confirmation SMS containing payment details.
1.5.1. The retail sale and purchase agreement for the Goods shall be deemed concluded from the moment the Seller issues the Buyer a cash receipt, sales receipt, or another document confirming payment for the Goods.
1.5.2. By providing their email address and phone number to the Seller, the Website Visitor/User/Buyer consents to the use of these means of communication by the Seller, as well as by third parties engaged by the Seller for the purpose of fulfilling obligations to Website Visitors/Users/Buyers. Such communication may include promotional and informational messages regarding discounts, current and future promotions, other Seller activities, order shipment notifications, and other information directly related to the fulfillment of obligations under this Public Offer.
By placing an Order, the User/Buyer agrees that the Seller may delegate the performance of the Agreement to a third party while remaining responsible for its fulfillment.
1.6. All rights and obligations under the Agreement concluded with the User arise directly with the Seller. By accepting this Agreement, the Buyer fully understands and agrees that if an agreement is concluded with a Seller other than FOP Sorochan T.V., FOP Sorochan T.V. shall not be a party to such agreement and shall not bear obligations related to its performance, except as provided for by this Public Offer.
- Subject of the Agreement
2.1. The subject of this Agreement is to provide the User with the opportunity to purchase Goods presented in the Online Store catalog at https://bucocoffee.com.ua for personal, family, household, and other needs not related to entrepreneurial activity.
2.2. This Agreement applies to all types of Goods and services presented on the Website as long as such offers remain available in the Online Store catalog.
- Website Registration
3.1. Registration on the Website is carried out through the "My Account" section.
3.2. Registration on the Website is not mandatory for placing an Order.
3.3. The Seller shall not be responsible for the accuracy and correctness of information provided by the User during registration.
3.4. Communication between the User/Buyer and call center operators, managers, and other Seller representatives shall be based on generally accepted standards of morality and communication etiquette.
The use of obscene language, profanity, offensive expressions, threats, or blackmail is strictly prohibited regardless of the form in which they are expressed or to whom they are addressed.
- Goods and Purchase Procedure
4.1. The Seller ensures the availability of Goods presented on the Website in its warehouse.
Photographs accompanying the Goods are illustrative only and may differ from the actual appearance of the Goods.
Descriptions and specifications accompanying the Goods are not exhaustive and may contain typographical errors. To clarify information regarding the Goods, the Buyer should contact Customer Support.
4.2. If the Goods ordered by the Buyer are unavailable in the Seller’s warehouse, the Seller reserves the right to exclude such Goods from the Order or cancel the Order by notifying the Buyer via email sent to the address provided during registration (or via a call from the call center operator).
4.3. The Buyer bears full responsibility for providing inaccurate information that results in the Seller being unable to properly fulfill its obligations.
4.4. In the event of cancellation of a fully or partially prepaid Order, the cost of the canceled Goods shall be refunded to the Buyer by a method chosen by the Seller, or deducted from the amount of the Buyer’s next Order.
4.5. After placing an Order on the Website, the Buyer shall receive payment details via email and SMS.
The manager responsible for processing the Order shall clarify Order details and agree on the delivery date, which depends on the availability of the ordered Goods and the time required for processing and delivery.
4.6. The estimated date of transfer of the Order to the delivery service shall be communicated to the Buyer by the manager handling the Order during a confirmation call, if such an option was selected by the Buyer when placing the Order.
The Seller reserves the right to change the shipment date unilaterally if objective reasons arise.

Delivery of the Order
5.1. The Goods are formed and delivered by a postal operator in the form of a postal shipment only after full prepayment of the Order by the Buyer. Delivery methods and approximate delivery times are indicated on the Website in the “Delivery and Payment” section at https://bucocoffee.com.ua.
5.2. The delivery territory of the Goods presented on the Website is limited to the territory of Ukraine.
5.3. Delivery delays may occur due to unforeseen circumstances beyond the Seller’s control.
5.4. Upon delivery, the Order is handed over to the Buyer or to a third party specified in the Order as the recipient (hereinafter collectively referred to as the “Recipient”).
5.5. The risk of accidental loss or accidental damage to the Goods passes to the Buyer from the moment the Order is handed over to the Recipient and the Recipient signs the documents confirming delivery.
5.6. To prevent fraud and to fulfill obligations set forth in clause 5.4 of this Agreement, when handing over a prepaid Order, the delivery person has the right to request an identity document of the Recipient and record its type and number in the delivery receipt. The Seller guarantees confidentiality and protection of the Recipient’s personal data.
5.7. The cost of delivery for each Order is calculated individually based on the weight of the Goods, region, and delivery method.
5.8. The Seller’s obligation to deliver the Goods to the Buyer is considered fulfilled at the moment the Buyer receives the shipment, as defined by applicable postal service regulations.
5.8.1. The procedure for delivery and opening of shipments containing Goods is determined by the applicable postal service rules.
5.9. The User understands and agrees that:
Delivery is a separate service that is not an integral part of the purchased Goods. Its execution is completed at the moment the Recipient receives the Goods and pays for them.
Claims regarding the quality of the purchased Goods arising after receipt and payment are considered in accordance with the Law of Ukraine “On Protection of Consumer Rights” and the Seller’s warranty obligations.
Therefore, purchasing Goods with delivery does not entitle the Buyer to demand delivery of Goods for warranty service or replacement, does not provide for on-site warranty service or replacement, and does not imply reimbursement of delivery costs in cases where the Buyer is entitled to a refund for the Goods themselves under the Law of Ukraine “On Protection of Consumer Rights”.

Payment for Goods
6.1. The price of the Goods is indicated in Ukrainian hryvnia and does not include value added tax, as the Seller applies the general taxation system.
6.1.1. The total order amount consists of the cost of the ordered Goods.
6.2. The price of the Goods is indicated on the Website. In case of incorrect pricing, the Seller shall inform the Buyer to confirm the Order at the corrected price or cancel it. If the Seller cannot contact the Buyer, the Order is considered canceled.
6.3. The price of Goods on the Website may be changed by the Seller unilaterally. However, the price of Goods already ordered by the Buyer shall not be changed.
6.4. Payment for Goods is made by the Buyer:
6.4.1. by non-cash payment using bank cards when placing the Order in the amount corresponding to the Order total shown on the Website, taking into account discounts.
6.5. FOP Sorochan T.V. has the right to provide discounts and implement a bonus program. Types of discounts, bonuses, and their application conditions are determined by the Seller independently and are indicated on the Website.

Returns of Goods and Refunds
7.1. Return of non-conforming Goods:
Non-conforming Goods are considered those with inappropriate taste, smell, or expired shelf life. The received Goods must match the description on the Website. Differences in design or packaging from the description do not constitute non-conformity.
7.2. The appearance, completeness of the Goods, and completeness of the entire Order must be checked by the Recipient at the time of delivery.
7.3. After receiving the Order, claims regarding external defects, quantity, completeness, or appearance are not accepted.
7.4. If the Buyer receives Goods of inadequate quality, they may exercise their rights under Article 8 of the Law of Ukraine “On Protection of Consumer Rights”.
7.5. Refunds are made by returning funds via postal transfer, bank transfer (via PrivatBank), or bank card transfer (the card must be issued in Ukraine; currency — UAH). The method is determined during a call with the call center operator.
7.6. The Seller is not responsible for defects in the Goods if they arose after transfer to the Buyer due to improper use, storage violations, actions of third parties, or force majeure.

Liability
8.1. The Seller is not liable for any damage caused to the Buyer as a result of improper use of Goods purchased in the Online Store.

Privacy and Data Protection
9.1. Personal data of the User/Buyer is processed in accordance with the Law of Ukraine dated June 1, 2010 No. 2297-VI “On Personal Data Protection”.
9.2. Personal data is collected solely for compliance with tax regulations, accounting requirements, and advertising purposes. Storage and processing period is 5 years.
9.3. During registration on the Website, the User provides: surname, first name, email address, phone number, and password for access.
9.4. By providing personal data during registration, the User agrees to its processing, including for promotional purposes.
9.5. Personal data is used:

for User registration on the Website;

for fulfillment of obligations to Users/Buyers;

for analysis and improvement of Website performance;

for determining winners in promotional campaigns.
9.5.1. The Seller may send informational and promotional messages via email and phone with the User’s consent. The User may refuse promotional messages at any time. Service messages related to orders cannot be disabled.
9.6. The Seller may use “Cookies” technology. Cookies do not contain confidential information and are not shared with third parties.
9.7. The Seller receives IP address information of Website visitors. This data is not used to identify individuals.
9.8. The Seller is not responsible for information provided publicly by Users on the Website.
9.9. The Seller may record telephone conversations for quality control purposes in accordance with Ukrainian law.

Term of the Public Offer
10.1. This Public Offer becomes effective upon acceptance by the Website Visitor/Buyer and remains valid until revoked.

Additional Terms
11.1. The Online Store may be temporarily unavailable due to technical maintenance or other reasons.
11.2. Relations between the User/Buyer and the Seller are governed by the laws of Ukraine.
11.3. Any disputes shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in court in accordance with Ukrainian law.
